Albanian Court releases Florenc Çapja and Suel Çela from jail; Police: these are dangerous criminals

Yesterday, on November 20, 2019, the Elbasan Judicial District Court, specifically the Judge Tomor Kullolli, has decided to release from prison one of the persons with strong criminal precedent in the context of crimes against the person.

The judge Kullolli has decided to dismiss the criminal case no. 40, 2006, for the offenses “Attempted Murder committed in co-operation” and “Unlawful possession of weapons and ammunition”, in charge of the defendant Florenc Çapja against the victim F.M., with the argument that this criminal offense is not proved.

We clarify the public opinion that Florenc Çapja was arrested on June 14. 2019, during the police operation "Krasta", conducted in Elbasan, after the investigations conducted by the Central Investigation Unit in the Criminal Police Department, based on evidence administered in cooperation and under the direction of of the Elbasan Judicial Prosecutor's Office turned out to be the perpetrator of the attempted murder of a former police officer, - the citizen F.D .- an incident that occurred in 2006. In connection with this incident, after carrying out some investigative and procedural actions in 2007, the Prosecution at the Elbasan Court of First Instance has decided to terminate the investigations of this citizen and to suspend the investigations regarding the criminal proceedings no. 40, 2006 and the acts of this criminal proceeding were forwarded to the Elbasan Police Directorate for the purpose of discovering the perpetrator.

In 2018, officers of the Special Task Force Investigation Unit of the Criminal Police Department of the State Police have launched a report at the Elbasan District Court Prosecutor's Office with a view to resuming investigations into this criminal case.

On the basis of this report, the Elbasan Judicial Prosecutor's Office has resumed the investigation into this criminal proceeding. During the investigative actions carried out in close cooperation with the Elbasan Judicial Prosecutor's Office, during 2018 and 2019, it was possible to legally document this event, and the Court then assigned the security measure "Arrest in Prison" to the suspected author Florenc Çapja.

Based on the administered evidence, after conducting a series of investigative and procedural actions, following the analysis in cooperation with the Prosecution, it was decided that the event would receive another qualification, from “Intentional Murder Remained in tentative” and “Unlawful possession of weapons and ammunition,” in “Attempted Murder Committed in Co-operation” and “Unlawful possession of firearms and ammunition”.

We emphasize the fact that the citizen Florenc Çapja, who was detained during the operation "Krasta", has appealed the security measure in two cases, but again the Elbasan Court of Appeal and the Durres Court of Appeal have upheld the security measure "Arrest in jail".

Upon the communication of the indictment to the citizen Florenc Çapja, the Prosecutor of the case requested the Court to transfer the case to trial, which was reviewed by Judge Tomorr Kullolli.

He has kept the file for about a month and a half under review and yesterday on November 20, 2019, by shortening the decision (13-2019- 6855) decided to dismiss the criminal case no. 40, 2006, for the offenses of “Attempted  Murder in Co-operation” and “Unlawful Holding of Weapons and Combat Ammunition”, Charged by Defendant Florenc Çapja, to the Victim F.M ..

We note the fact that citizen Florenc Çapja is suspected of being one of the leaders of a dangerous criminal group operating in the Elbasan district and even beyond, he has been arrested many times for serious criminal offenses, but he has been released and escape punishment by virtue of these arbitrary decisions of the lawless, law-making bodies. This decision is not the final, but this made for this high-risk individual today to be free.
